Introduction
Regulations – These Regulations specify the rules for participation in the Loyalty Program, including the rights and obligations of the Participant and the Organizer. The provisions contained in these Regulations constitute the regulations for providing electronic services within the meaning of Article 8(1)(1) of the Act of July 18, 2002, on the provision of electronic services.
Definitions
Organizer – BANGKOK limited liability company with its registered office in Bydgoszcz, Gdańska 36, 85-008 Bydgoszcz, entered into the National Court Register by the District Court Gdańsk-Północ in Gdańsk, VIII Economic Division of the National Court Register under the KRS number: 0000808012, share capital of 5,000 PLN fully paid, NIP: 588 245 35 15, REGON 384591779.
Participant – any natural person, not conducting sole proprietorship or conducting sole proprietorship, for whom the Services acquired do not have a professional character, having:
- full legal capacity, or
- limited legal capacity and written consent of a legal guardian
- or another entity with legal capacity, which joined the Program on the terms described in the Regulations,
who creates an Account.
Registration form – a form available on the Organizer’s website, the completion of which is necessary to join the Loyalty Program.
Account – the individual account of the Participant, created after the Participant completes the Registration Form. Access to the Account is possible after logging in. The Account is valid until it is deleted by the Participant.
Loyalty program/Program – an activity aimed at rewarding Participants who, in particular, purchase goods or services from the Organizer, and also post reviews on internet portals regarding the Organizer’s activities, as specified in the Regulations. The Program is organized in the territory of the Republic of Poland and lasts from December 1, 2023, until further notice.
Points – values awarded to the Participant by the Organizer for the purchase of products or services, excluding subscriptions, at a rate of 1 point for every spent PLN 1 (1 PLN = 1 point). Participants can check Points and Rewards after logging into their Account.
Reward – a service, product, or other benefit that the Organizer has placed in the rewards catalog, available in Attachment 3 to the Regulations, which can be exchanged for Points accumulated in the Program.
PARTICIPATION
- For proper participation in the Program, the Participant must have a registered Account in the Program, enabling the collection of Points.
- Participation in the loyalty program is possible by completing and sending the Registration Form and accepting these Regulations.
- The Participant has the right to resign from participation in the Program at any time by deleting their Account. Resignation takes effect immediately, and all accumulated points are forfeited, meaning that their later recovery, use, or transfer to other existing or newly created Accounts is not possible.
- The participants of the Program can participate only personally, and their participation is not transferable to other individuals.
- Each Participant can have only one account at a time in the loyalty program run by the Organizer. After deleting the account, it is possible to create a new one, but without the possibility of transferring or recovering earned Points.
POINT AWARDING RULES
- Points are awarded only at the time of the transaction. The Organizer reserves that the update of the number of Points in the Account may take up to 24 hours from the transaction.
- The moment of concluding the transaction is considered the moment when the Participant pays for the purchase of the service or goods.
- Points are valid until the Participant deletes the Account.
- To accrue Points, the Participant is obliged, before the transaction, to inform the Organizer’s employee by identifying themselves with the phone number assigned to the Account.
- Program points may be awarded only once for each activity.
- As part of contests and promotional activities, Participants may be awarded additional points or additional rewards, according to rules specified separately for periodically conducted actions.
- The Organizer has the right to correct the Participant’s point pools if the points were awarded incorrectly. In each such case, the Participant has the right to obtain information about the reason for such correction by contacting the Organizer.
- Points accumulated by the Participant cannot be converted into money, sold, or transferred to a third party.
- The Program is not combined with other promotions, sales, and other loyalty and partnership programs of the Organizer.
RULES FOR EXCHANGING POINTS FOR REWARDS
- The Participant can exchange the Points collected in the Program for Rewards.
- The list of prizes along with the number of Points required to receive them is available on the Organizer’s website after logging into the Account.
- Rewards can be collected at the Organizer’s salons or in the Organizer’s online store. The list of Organizer’s salons is available on the website at: www.spabangkok.pl
- To collect the reward, the Participant exchanges points for the reward. The reward can be collected at the salon after making an appointment and informing the receptionist of the intention to use the reward in the program. Collection of the reward in the Organizer’s online store is done by selecting the appropriate reward after logging into the Account.
- Collecting the Reward results in reducing the number of Points of the Participant by the number of points necessary to collect the selected Reward. The Organizer reserves that the update of the number of Points in the Account may take up to 24 hours from collecting the Reward.
- The Organizer has the right to ask the Participant for written confirmation of receiving the reward at the time of its issuance.
- If the Participant decides to return the Reward, the Points used to obtain the Reward will not be returned to them.
- The Sponsor of the Rewards is the Organizer.
PRIVACY POLICY
- The Organizer is the administrator of the personal data of the Participants of the Program.
- The Organizer will process the following personal data: first name, last name, e-mail address, phone number, and address.
- The personal data of the Participant will be processed to implement and participate in the Program.
- Providing personal data is voluntary but necessary to participate in the Program.
- Each Participant has the opportunity to:
- access their personal data and the right to request their correction, deletion, or limitation of processing;
- data portability;
- withdraw consent to the processing of personal data – to the extent that the basis for the processing of the Participant’s personal data is consent (withdrawal of consent does not affect the legality of the processing carried out based on consent before its withdrawal);
- object to the processing of personal data – to the extent that the basis for the processing of the Participant’s personal data is the legitimate interest of the Administrator;
- complain with the supervisory authority responsible for the protection of personal data (President of the Office for Personal Data Protection), if the Participant believes that the processing of data by the Administrator violates the GDPR.
- In the event of resignation from participation in the Program, the personal data of the Participant will be deleted.

FINAL PROVISIONS
- In the event of any irregularities in the accrual of Points, the Participant has the right to complain by e-mail to program@spabangkok.pl. The complaint must include:
- Participant’s first and last name,
- Description of the complaint,
- Transaction confirmation – receipt, transfer confirmation, or card payment confirmation,
- Date of the problem occurrence,
- Date of problem disclosure.
The complaint will be considered within 14 days, and information about its consideration will be sent to the Participant at the email address from which they sent the complaint.
- The Organizer has the right to terminate the Program at any time by sending information about the Participant’s Account and posting an announcement on the Organizer’s website.
- The termination date of the Program will be provided in advance, not less than 30 days. After the end of the Program, the exchange of Points, both for Rewards and cash, will not be possible.
- The Organizer is obliged to enable the Participant to exchange Points for Rewards before the end of the Program.
- The Regulations may be changed at any time by posting a new version of the Regulations on the Organizer’s website and individually notifying each Participant by electronic means at the email address or phone number provided in the Participant’s Account. If the Participant does not report a lack of acceptance within 14 days of the announcement of the changes, it is assumed that the Participant accepted the changes. Participants who do not accept changes to the Regulations will not be able to continue using the Program; however, they will be able to use the accumulated points on the existing terms.
- For all rights and obligations arising from the Loyalty Program, Polish law applies.
